PRACTICE

Richard Maurer is a partner of the firm, practicing in the Blue Bell and Allentown offices. Formerly a partner at White and Williams, Richard’s practice is devoted to trial and appellate advocacy, in the civil and criminal arenas.  Richard has tried more than a dozen cases to jury verdict, and has briefed numerous successful appeals to state and federal courts, including the United States Supreme Court.  Richard is well-acquainted with many different areas of the law, from class actions to First Amendment litigation, from civil rights to federal criminal defense.  Richard has defended automobile and bicycle manufacturers in product liability cases, and has represented a major US shipyard in catastrophic personal injury claims.  A graduate of the Juilliard School, Richard remains active as a musician, recently gaining favorable reviews as the onstage cellist in Melancholy Play, a new work by playwright Sarah Ruhl.

 

REPRESENTATIVE MATTERS:

• Class Actions: obtained an Order decertifying the class that had previously been approved in statutory penalty litigation against a regional insurance company. Freedom Medical v. PMA Companies.

• First Amendment: defended Penn State University in defamation claims brought by students and former faculty members. Deana-Jak v. Penn State.

• Commercial Litigation: represented a concrete company based in Czestochowa, Poland in a successful breach of contract/warranty case against a US-based manufacturer. Euro-Ted v. KRB Machinery.

• Criminal Defense: defended a physician charged in a 332-count indictment, in a three-month federal jury trial in the Eastern District of Pennsylvania. United States v. Jeffrey C. Bado.

• Insurance Defense: Obtained summary judgment for an insured in a Philadelphia case asserting that the insured’s negligence resulted in a minor’s intoxication and resulting social host liability. Nuss v. PMC Properties.

• Appeals: Obtained a decision from Pennsylvania Superior Court, reversing the verdict in a medical malpractice case based on prohibited “trial by ambush.” Bonilla v. Jeanes Hospital.

• Appeals: Obtained a decision from Pennsylvania Superior Court, reversing judgment against a French paint gun manufacturer on grounds that plaintiff had failed to establish successor liability. Cargitlada v. Binks Sames, S.A.

• Criminal Appeals: Obtained a decision from Pennsylvania Superior Court, holding that defendants charged with violating probation are entitled to consideration of the same sentencing factors that apply to persons who are not on supervision. Commonwealth v. Derry.

•  Trials: Defended one of the first Internet defamation cases filed in Pennsylvania, culminating in a 10-day jury trial in Northampton County. Fulmer v. Swidler.
