Michael J. McCaney, Jr. specializes in litigating civil matters, including disputes relating to contracts, employment, construction, civil rights, civil RICO, zoning, trade name infringement and other matters.  Michael was Special Trial Counsel to the Pennsylvania Department of Transportation, where he was responsible for conducting high-impact and complex litigation.  Michael also served as the Personnel Attorney for that Department and represented the Department in construction claims before the Pennsylvania Board of Claims, as well as in appellate matters.  Michael also served as a prosecutor for the Bureau of Professional and Occupational Affairs where his responsibilities included review of cases, negotiations and prosecutions before professional licensing agencies.

He is a 1973 graduate of the University of Pittsburgh, from which he received his B.A. in History.  Michael received his J.D. from Duquesne University in 1978.

In franchise law, Michael concentrates in analysis, acquisition, development, establishment and day-to-day operations of the franchise unit, area developments, franchisee associations, franchise-broker relations and franchise litigation, arbitration and mediation.

In employment law, Michael argued before the Pennsylvania Supreme Court the case of Chmill v. City of Pittsburgh, which presented an issue of racial discrimination and its interplay with the Civil Service Law of the City of Pittsburgh and the case of Commonwealth, Department of Transportation v. Pennsylvania Human Relations Commission, which challenged the procedures of the Commission as violative of the Pennsylvania Human Relations Act.  Michael has tried numerous discrimination cases to their conclusion, including successfully defending a claim of sexual harassment in the case of Fields v. Horizon House, Inc.

Michael is a member of the Pennsylvania and Montgomery Bar Associations, the Brehon Law Society, and is on the Board of the Pennsylvania Prison Society.  Michael is admitted to practice before the Supreme Court of the United States, the United States Court of Appeals for the Third Circuit, the United States District Court for the Eastern, Middle and Western Districts of Pennsylvania, as well as before all courts of the Commonwealth of Pennsylvania.
